First of all, common law marriage is not legal in West Virginia. West Virginia does not recognize common law marriages, and an official marriage license must be obtained for a couple to be legally considered married in the state. Furthermore, when obtaining a marriage license, both parties must be physically present. In other words, “proxy” marriages are not allowed in the state of West Virginia. Also, it is illegal to marry someone of relation to you. However, this extends only to your second cousins. Fortunately, a blood test is not required to prove you are not related to your partner. Also, both parties must be 18 or older to be legally married. If you are 16 or 17, however, you may be legally married with your parent’s consent. Also, a three day waiting period is put in place for couples under the age of 18. Otherwise, no waiting period is required to obtain a marriage license in WV. Furthermore, a valid ID is required when obtaining a marriage license in West Virginia. Finally, both parties must know their parent’s’ full, legal names and where their parents were born.
